These Terms of Service ("Terms") govern your use of the Buried mobile application ("Buried" or "the app"). The app is developed and operated by Alvin Armanni ("I," "me," or "developer"). By downloading, installing, or using Buried, you agree to these Terms. If you do not agree, do not use the app.
I grant you a limited, non-exclusive, non-transferable license to use Buried for your personal, non-commercial use, in accordance with these Terms and the Apple Media Services Terms and Conditions (where applicable). You may not reverse-engineer, copy, or misuse the app or its content.
Buried requires you to travel to real-world locations to unlock digital capsules. By using the app, you agree that:
Buried stores your capsules and media on your device. I do not back up your data to my own servers. You acknowledge that deleting the app, losing your device, or hardware failure may result in permanent loss of your time capsules. I am not responsible for any lost data.
Buried may offer premium features via auto-renewing subscriptions or one-time purchases through the Apple App Store. All payments are processed by Apple. Refunds are subject to Apple’s policies. You can manage or cancel subscriptions in your Apple ID Account Settings. Prices and availability may change.
These Terms are between you and Alvin Armanni, not Apple. Apple has no obligation to provide maintenance, support, or any other services for Buried. Apple is not responsible for any claims relating to the app or your use of it. To the extent permitted by law, Apple has no warranty obligations for Buried.
The app is provided "as is" and "as available." I strive to keep GPS locking accurate but do not guarantee that location services will be 100% accurate or available at all times. I disclaim all warranties, express or implied, to the fullest extent permitted by law.
To the fullest extent permitted by law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profit, arising from your use or inability to use the app. In no event shall my total liability exceed the amount you paid to me (if any) in the twelve months before the claim, or one hundred US dollars, whichever is less. Some jurisdictions do not allow certain limitations; in those jurisdictions, my liability will be limited to the maximum extent permitted by law.
You agree to indemnify and hold me harmless from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the app, your violation of these Terms, or your violation of any law or third-party rights (including trespass or privacy).
You may stop using the app at any time. I may suspend or discontinue the app or your access at any time, with or without notice. Sections that by their nature should survive (including limitations of liability, indemnification, and governing law) will survive termination.
I may update these Terms from time to time. I will indicate changes by updating the "Last Updated" date at the top. Continued use of the app after that date means you accept the updated Terms. If you do not agree, you must stop using the app.
These Terms are governed by the laws of Sweden, without regard to its conflict of law rules. Any dispute arising from these Terms or the app shall be resolved in the courts of Sweden, and you consent to the personal jurisdiction of those courts. If you are a consumer in the European Union or the European Economic Area, your mandatory statutory rights under the law of your country of residence remain unaffected.
If any part of these Terms is held invalid or unenforceable, the remaining parts will remain in effect. My failure to enforce any right does not waive that right. These Terms constitute the entire agreement between you and me regarding Buried.
